DIRECT TV Terms and conditions:
The following sales terms apply for products that incorporate DIRECTV technology (contain a DIRECTV access card). By purchasing DIRECTV equipment you are indicating your express acceptance of the following: Subscriber Representation 1. As the purchaser, you assume all responsibilities for the terms listed herein both as the purchaser of the DIRECTV equipment and on behalf of the DIRECTV programming subscriber if he or she is different than you. Activation 2. You will install and activate all DIRECTV Receivers (access cards) purchased at a residential, noncommercial dwelling within the Continental United States, at the physical address, and phone number provided at the time of the order. 3. You will activate DIRECTV service using the DIRECTV account number unless you are a current DIRECTV subscriber for all DIRECTV Receivers purchased. Receipt of DIRECTV programming is subject to these Terms of Sale and the DIRECTV Customer Agreement; a copy is provided at directv.com and in your first billing statement. 4. DIRECTV programming will be activated on each DIRECTV Receiver purchased within 30 days of receipt. 5. DIRECTV programming will be activated on each DIRECTV Receiver purchased using the original access card included in the equipment. 6. ACTIVATION OF PROGRAMMING MAY BE SUBJECT TO CREDIT APPROVAL AND REQUIRES VALID SERVICE ADDRESS, SOCIAL SECURITY NUMBER AND/OR MAJOR CREDIT CARD. Programming Commitment 7. The following applies to purchases by both new and existing DIRECTV subscribers: a. You agree to activate (or upgrade if applicable for existing DIRECTV customers) to a DIRECTV programming package valued at $31.99 a month or above and maintain such programming on your DIRECTV account for a period of twelve (12) consecutive months, without interruption. b. If you are an existing DIRECTV subscriber, this programming commitment will supersede any existing DIRECTV programming commitment on your existing DIRECTV account. c. When contacting DIRECTV to activate service, your acceptance of the 12-month programming commitment agreed to herein must be verbally acknowledged with the DIRECTV representative. This is the purchaser’s responsibility regardless of who contacts DIRECTV. d. All DIRECTV Receivers purchased must remain active for twelve (12) consecutive months, without interruption. Please note that there is a monthly program-mirroring fee (currently $4.99, subject to change by DIRECTV) per additional Receiver (e.g., for Receivers 2, 3, 4…). e. After you have fulfilled your twelve (12) month programming commitments as listed above, you are not obligated to continue your subscription for DIRECTV programming for any specific duration. Potential Charges 8. You are pre-authorizing us to charge the credit card you used on the order with a one-time fee, as listed below, for each DIRECTV Receiver (access card) purchased should you fail to fulfill the terms as listed herein. a. All DIRECTV Systems/Receivers: $225.00 per receiver. 9. You agree to pay store any and all costs associated with the collection of fees detailed above, including those fee amounts, should the credit card entered have insufficient funds or be declined for any reason whatsoever. Return Policy 10. All returns must be made within 30 day's of receiving your equipment. You must contact us to set up your return, to insure that all items are shipped to the correct address. 11. Returns must be sent freight prepaid. No COD returns will be accepted. Shipping & handling fees (original and return) are nonrefundable. 12. Returned merchandise must include all original components, literature, warranties, and packaging in the same sellable condition you received it. 13. All returned Systems and Receivers will be inspected for original parts and access cards. If a Receiver is returned without its original and assigned access card, a $225 fee per receiver will be charged to the credit card used for the purchase. 14. All items returned after 30 day's without prior consent from merchant and 4 Peaks Home Entertainment, Inc. will be refused and returned to the customer. All potential charges apply. 15. All returns are subject to a $19.95 minimum restock fee or 20% of the sale whichever is greater. 16. If you return the DIRECTV equipment under the standard merchant Return Policy, where you also ordered Professional Installation, you may be liable for a nonrefundable $50.00 trip fee to be deducted from the order total less shipping and handling. This fee will come into effect if the installer comes to the physical location where the DIRECTV equipment is to be installed and cannot obtain a line of sight. If the order total was less than $50.00, then you pre-authorize merchant to charge the credit card used on the order with the difference (non refundable) to be determined at the time of return processing. 17. If you return the DIRECTV equipment under the standard merchant Return Policy, where you also ordered Professional Installation, you will be liable for a one-time nonrefundable $150.00 post-installation cancellation fee. This fee will only come into affect if you cancel or return the order after the installation has been completed. Cancellation Policy 18. Orders that are canceled prior to processing and shipment will be canceled free of charge with no restock fee. Final shipment and processing usually happens within 1 hour of your initial order, but can be processed more quickly. You must contact us immediately to avoid an restock fee's. 19. All orders that are canceled after processing and shipment are subject to a $19.95 minimum restock fee or 20% of the sale whichever is greater, and must be returned immediately upon equipment arrival. Any and all orders refused at shipping address will incur a 20% restocking fee or a $19.95 charge, whichever is higher. 20. If you have canceled your installation for any reason, you must contact us immediately to explain the reason and nature of your intention. You have three options at this point as listed below, or potential charges will apply: a) You must return the equipment to us immediately to avoid any potential charges. All restock fee's apply. b) You must continue to make arrangements to have your DIRECTV System installed and activated per the 30 Day Activation terms and guidelines. c) You must make other arrangements at your own expense whether using an alternate professional installation company or choosing a self install method, to install and activate your DIRECTV System within 30 day's. Payment Policy 21. Merchant only accepts Visa, Mastercard, Discover and AMEX as valid forms of payment. Debit Cards that have the Visa or Mastercard logo are accepted. NO COD's, Online Check Drafts, Or Check Payments will be accepted. 22.Merchant process's all forms of payment under 4 Peaks Satellite and Sound, or as 4 Peaks Home Entertainment, and will reflect as such on your credit card invoice and statements. 23. Fraudulent Disputes and or Fraudulent Charges to your credit card company will result in criminal prosecution, under the Governing Laws of the State of Arizona. We report all forms of fraudulent transactions. 24. Merhcant reserves the right to refuse service or cancel orders at our sole discretion. By ordering any item from merchant and 4 Peaks Home Entertainment, Inc whether by online means or by our toll free method, you are fully agreeing to any and all terms herein. Refund Policy 25. Any item that is returned within the terms of the return policy, will be refunded to the original credit card that was used to make the purchase, less any applicable and appropriate fees. 26. Any item that is returned within the terms of the cancellation policy, will be refunded to the original credit card that was used to make the purchase, less any applicable and appropriate fees. 27. All chargebacks as listed in the potential charges section are nonrefundable. Privacy Policy 28. All customer information obtained by Merchant for the purpose of selling the equipment is strictly private and will not be sold to any outside sources. 29. When inquiring about an order, you must provide the invoice #, first and last name, along with the telephone number that was used to place the order. This is to ensure that your information remains private. 30. We will not give out or repeat any credit card information even upon customer request. We reserve the right to modify our terms as needed. Offer available only to new residential customers who purchase a new DIRECTV System (a receiver with a dish) and activate a new 12 month subscription to a DIRECTV® TOTAL CHOICE® programming package What's included with our standard professional installation Standard Professional Installation of your DIRECTV System includes: Mounting of your satellite dish on an outside wall or roof with the necessary hardware, within 125 ft. cable length of your TV Up to 125 ft. of RG-6 cable or up to 250 ft. for dual tuner receivers (DIRECTV Receivers with TiVo and DIRECTV Receivers with UltimateTV) that require two cables The hardware necessary to mount and ground your satellite antenna Connection to your TV and VCR, if collocated, and activation of DIRECTV® Programming The professional installer will teach you how to use the DIRECTV System, including programming your remote, and any services associated with DIRECTV Note: Additional installation services are available; see below for custom installation information. Line-of-Sight Requirements and Other Restrictions Unobstructed southern exposure. The DIRECTV satellites are located over the equator south of Texas. You must have southern exposure, unobstructed by tall buildings or trees, where the satellite dish is to be installed. Renters must have written permission from their landlord to show the installer prior to the start of the installation. Homeowners' associations may restrict where your dish may be installed. Please make sure to clear your planned installation with your homeowners' association if there is a restrictive covenant. |
DISH NETWORK Terms and conditions:
I agree to install and activate all receivers within 14 days of the day the unit is delivered via UPS or to return the system.
I agree that my household and I will be FIRST TIME U.S. residential DISH Network subscribers. This means that you have never had an account set up with DISH Network. First time subscribers pay only $49.99 which includes a 1 time $15.00 non-refundable application processing fee, $24.99 shipping and handling (refundable until shipping has occurred) and a 1 time $10.00 Activation fee (refundable until system activation). Please Note: If you are already an existing or previous Dish Network customer, this new promotional offer is NOT available to you. This promotion is for NEW/FIRST TIME Dish Network customers only. There will be no refunds made if you are an existing or previous customer. If you are a new customer for this promotion and wish to order additional receivers now or later on, you may do so. I agree to initially activate my receivers within 14 days after receipt of delivery and also to subscribe to a minimum 12 consecutive months of America's TOP 100, America's TOP 150 or DISH Latino Programming Service. (You do not have to prepay the 12 consecutive months however you do need a major credit card to activate this program.) I agree that the activation address will be the same as the purchase address on the Dish Network Agreement which will indicate that I am a first time customer. In the event that you fail to maintain any of the above agreed upon terms in installing and activating your satellite receiver systems from MyDishNow within 14 days after receipt of delivery or return the inactivated unit to us, you hereby authorize MyDishNow to charge a surcharge of $330 for the first receiver and $100 for each additional receiver because you have failed to comply and you authorize the issuer of the credit card to pay that amount. If you order more than 1 receiver, all must be activated to avoid a cancellation fee. You authorize such charge without MyDishNow submitting a signed receipt and agree that this Agreement is to be accepted as such authorization. In consideration of the equipment that is being shipped to you, Digital Home Plan activations require you to provide Dish Network with a Social Security Number (SSN). The SSN provided must match the name of the individual receiving the FREE equipment and the FREE basic professional installation and who will be subscribing to the Dish Network programming package. When Dish Network verifies your credit, any discrepancies in name, address or SSN provided may cause Dish Network to immediately reject your claim. Local TV Local TV channels are offered only in specified areas and may be provided through an outdoor antenna or a local dish antenna. Off-air broadcast picture quality may vary based upon location. Return Policy If you are not satisfied and have not activated your system after 14 days of receipt of delivery, you will be responsible for shipping the system back to us via UPS or US Mail and it must be insured for $300. If we do not receive your system back you will be charged $330 for the first receiver and $100 for each additional receiver as outlined above. If you require that we pick up the package, no refund of any portion of your original payment will apply. Requests for cancellation will only be accepted for 60 days from the date of the initial order. There is a restocking charge of $30 on all equipment returned after 30 days and there are no refunds after 60 days from the date of receipt of your equipment. No Line of Sight If it is determined by the installer that you do not have a clear line of sight you must return all of the equipment. The equipment must be returned to us via UPS or US Mail and must be insured for $300.00. Upon receipt of your system we will issue you a credit of the activation fee. If we do not receive your system back you will be charged $330 for the first receiver and $100 for each additional receiver as outlined above. If you require that we pick up the package, no refund of any portion of your original payment will apply. We will not charge you any additional Return Policy charges. Each receiver must be activated at the time of installation. More than 2 receivers requires the purchase of a a quad LNB multi-receiver switch for $24.95 at the time of the original order. If you attempt to install the system yourself and do not follow the proper activation procedures and if we do not receive your system back you will be charged $330 for the first receiver and $100 for each additional receiver as outlined above.
